If you are not in the delivery driver will leave your order in a safe place providing you have added this to your delivery instructions and a card will but put through your door to let you know they have delivered.

Definitions

“Buyer” means the individual or organisation who buys or agrees to buy the goods from the Seller.

“Consumer” means someone who buys goods from the Seller and who does so otherwise than in the course of a business.

“Contract” means the contract between the Seller and the Buyer for the sale and purchase of goods incorporating these terms and conditions.

“Goods” means the goods and/or services that the Buyer agrees to buy from the Seller.

“Seller” means H M Sheridan, registered at 11, Bridge Street, Ballater, AB35 5QP.

“Terms and Conditions” means the terms and conditions of sale set out in this document.

“Website” means this website or any replacement website substituted therefor by the Seller.

 Conditions

Nothing in these Terms and Conditions shall affect the Buyers statutory rights as a Consumer.

These Terms and Conditions shall apply to all contracts for the sale of goods by the Seller to the Buyer through the Website and shall prevail over any other documentation or communication from the Buyer.

The Seller reserves the right to amend the Terms and Conditions at any time without notice, and the terms and conditions applicable to each Contract between both the Buyer and Seller shall be those prevailing at the time of an order being placed by the Buyer.

The placing of an order by the Buyer shall be deemed conclusive evidence of the Buyer’s acceptance of these terms and conditions.

No variation to these terms and conditions (including any special terms and conditions agreed between the parties) shall be permitted.

 Ordering

All orders for goods shall be deemed to be an offer by the Buyer to purchase goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason. It should be noted that a simple acknowledgement of order may be issued which shall not be deemed to be acceptance of an order unless stated otherwise.

If goods are ordered by the Buyer and are not available the Buyer shall be notified and given the option to wait until the goods become available or the option to cancel the order and receive a full refund.

Certain security checks may need to be carried out by the Seller, in which case any sale to a Buyer is subject to the Seller receiving satisfactory results from such checks.

Price and Payment

The price of the goods shall be that displayed on the Sellers Website. The price is inclusive of VAT and will include delivery charges.

The total purchase price, including VAT and delivery charges, will be displayed in the Buyers shopping cart prior to confirming the order.

After the order is received, the Seller shall confirm the details, description and price of the goods by email.

Payment of the price plus VAT and delivery charges must be made in full before dispatch of the goods. Payment can be made by any credit or debit card accepted by the Seller, details of which are displayed on the Website.

All orders are subject to authorisation of payment by the relevant card issuer prior to despatch or delivery of the goods.

Performance of Services

The Supplier shall perform the services with reasonable skill and care. However, where applicable, the Supplier does not guarantee that the Services will be uninterrupted, or error-free or that any data generated, stored, transmitted or used via or in connection with the Services will be complete, accurate, up to date, received or delivered correctly or at all. The Supplier may have to suspend the Services for repair, maintenance or improvement. If so, the Supplier will restore them as quickly as reasonably possible.

 Rights of the Seller

The Seller reserves the right to adjust the price and specification of any item on the Website at its discretion.

The Seller reserves the right to withdraw any goods from the Website at any time.

The Seller shall not be liable to anyone for withdrawing any goods from the Website or for refusing to accept an order.

 Warranty

The Seller cannot describe every detail of the goods in the Website and each description is therefore abbreviated and is correct at the time of its input. The Seller reserves the right to change the specification or description of goods on the Website without notice.

The goods may consist of goods and or services to be delivered online. The seller shall have no liability for any temporary unavailability of such goods due to any failure of the Website, any telecommunications system and or the World Wide Web in general, including any downtime of the Website due to planned or emergency maintenance.

 Delivery

Goods supplied within the UK will normally be delivered within 30 days of receipt of order.

Deliveries will normally be made within 48 hours of dispatch, and goods will only be dispatched on Monday, Tuesday and Wednesdays.

The Seller shall use its reasonable endeavours to meet any date agreed for delivery.

Not withstanding the foregoing, time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.

Delivery of the goods shall be made to the Buyers address specified in the order and the Buyer shall make all arrangements necessary to take delivery of the goods whenever they are tendered for delivery.

Title and risk in the goods shall pass to the Buyer upon delivery of the goods, or where the Buyer fails to take delivery at the agreed time, at the time delivery was attempted.

 Acceptance of Goods

The Buyer shall inspect the goods immediately upon receipt and shall notify the Seller within 24 hours of delivery if the goods are damaged or do not comply with any of the Contract. If the Buyer fails to do so the Buyer shall be deemed to have accepted the goods.

 Age of Consent

Where goods and or services may only be purchased by persons of a certain age the Buyer will be asked when placing the order to declare that they are of an appropriate legal age to purchase the goods or services.

If the Supplier discovers that the Buyer is not legally entitled to order certain goods and or services, the Supplier shall be entitled to cancel the order immediately, without notice.

 Limitation of Liability

Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the Price of the goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever suffered by the Buyer.

Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Sellers agents or employees.

We accept all credit cards via our payment partner Stripe.

Refund Policy

If for any reason you are not satisfied with your products please contact us so we can resolve any problems as quickly as possible.

Any requests for refunds must be made in writing or by email.

Please note that due to the perishable nature of our products, your right to cancel your order expires once we have dispatched your goods.
